This document establishes the general conditions that form an integral part of the contract stipulated between the occupants of the properties, hereinafter YOU and ALQUILERES OLTASUCH SL, with its registered office in Calpe, Calle de la Pau 2; and provided with CIF B-54575436; hereinafter PLUSHOLIDAYS, OUR or US.
When making a reservation, regardless of the contracting channel (directly through PLUSHOLIDAYS website, through external websites, agencies or tour operators which PLUSHOLIDAYS has collaboration with); YOU will accept each and every one of the conditions listed below.
1- PRICES AND SERVICES
The published prices of our villas, bungalows and apartments, will be specified daily or weekly.
In principle, during the high season, the minimum stay is 7 nights with changeover on Saturday. In middle and low season the arrival and departure in the accommodations could be made on another day of the week and shorter stays are allowed.
Extra expenses such as cleaning, sheets, towels, air conditioning, heating, extra beds, cots, high chairs ... may or may not be included in the price, depending on each accommodation. In case of not being included in the rental price, it will be specified before the acceptance of the conditions of reservation and of making the reservation; also it will be indicated in the invoice of the reservation.
2- PRICES AND SERVICES MODIFICATIONS
The prices and services can in some cases undergo some modifications that will be communicated at the time of making the reservation and confirmed later in writing.
It could be the case that such changes occurred after the booking was contracted and affected the essential points of the contract. In that case you could cancel the contract, without expenses, within five days, being reimbursed the payment made.
3- CONTRACT AND PAYMENT CONDITIONS
Reservations can be made through the website www.plusholidays.es, by telephone calling on (0034) 965 833 587 or directly at any PLUSHOLIDAYS office.
Payment method: 40% -30% -30% (Extras will be paid upon arrival)
40% of the accommodation amount will be paid, in a maximum period of 4 days from the realization of the reservation. 42 days before arrival, 30% of the accommodation amount must be paid. The remaining balance, 30% of the accommodation plus the extras booked, will be paid at the moment of entry, upon delivery of the keys.
Payments can be made by bank transfer (IBAN: ES54 2095 0203 8091 1144 3389, BIC: BASKES2BXXX), by credit card (VISA card or MASTERCARD) or in cash.
In case of non-compliance with the payment dates within a maximum of 4 working days, PLUSHOLIDAYS reserves the right to cancel the reservation without prior notice.
4 - CANCELLATIONS
In the event that YOU would cancel your reservation, the following penalties will be applied depending on the moment of cancellation:
- From the moment the reservation is made, up to 120 days before the arrival date: 30% of the total amount.
- Between 119 and 43 days before the arrival date: 40% of the total amount.
- Between 42 and 8 days before the date of entry: 70% of the total amount.
- Between 7 and 0 days before the date of entry: 100% of the total amount.
Upon arrival will be obligatory the presentation of a credit card, which will be registered as a deposit, in order to respond to the non-compliance by the occupants of the obligations indicated in these general conditions, as well as any damages caused in the leased property. May the guest not to present a credit card, PLUSHOLIDAYS reserves the right to prohibit entry into the accommodation, losing the renter the amounts delivered.
6- CUSTOMER OBLIGATIONS AND RULES OF USE
The occupation of the accommodation will be limited to the number of people indicated in the reservation, counting children and babies also as persons for the purpose of the occupation. PLUSHOLIDAYS can prevent entry to the accommodation in case of exceeding the number of people allowed, without generating any right to a compensation, or choose to increase the rental price according to the amount that PLUSHOLIDAYS consider appropriate.
The tenant must respect the rules of coexistence with neighbours and the municipal ordinances in force in the area. It is totally prohibited to hold events and parties, in all accommodations managed by PLUSHOLIDAYS. In case of negligence or inappropriate behaviour, PLUSHOLIDAYS reserves the right to cancel the rental contract with immediate effect and without prior notice, which may cause the total loss of the deposit and the rental amount.
Animals will be allowed only when requested at the time of booking and when confirmation of their acceptance has been confirmed in writing. In the event that one or more unauthorized animals are found during the guest stay, PLUSHOLIDAYS reserves the right to cancel the rental contract with immediate effect and without prior notice, which may result in the total loss of the deposit and the rental amount.
7- MAINTENANCE AND CONSERVATION
The accommodation will be hand over in perfect state of use and conservation, not being able to change or alter its decoration.
Hand over must be made in the same condition in which it was received, so that the property must be clean and tidy, without trash which must be removed by the occupant. Cabinets and refrigerators should be emptied.
Clutter and traces of dirt and trash will be penalized with a deduction of 150€ from deposit.
In case of non-return or loss of keys, PLUSHOLIDAYS will be obliged to deduct from the deposit a minimum amount of 50 €.
8- ARRIVALS AND DEPARTURES
Check-in will be made between 17:00h and 20:00h, by collecting keys at PLUSHOLIDAYS offices and by paying the whole outstanding amount, including the contracted extras. In the event that the guest arrives afterhours, a supplement of € 50 will be applied.
Check-out will be made before 10:00 am and the keys must be handed over to PLUSHOLIDAYS offices. The property must be in the same condition that was handed over: tidy and without trash. Otherwise, the supplement specified in the contract conditions will be charged to the guest.
9- LIABILITY ATTRIBUTABLE TO PLUSHOLIDAYS
In the event that the booked accommodation, due to unforeseen causes not attributable to PLUSHOLIDAYS, could not be occupied, PLUSHOLIDAYS is committed to look for an alternative solution of similar characteristics and price. If this is not feasible due to the lack of available accommodation or because YOU rejected all the proposals offered, the amount paid will be reimbursed.
10- INCIDENTS AND CLAIMS
In spite of having carefully prepared our catalog and having controlled all our accommodations, it could happen that the service was not of your total satisfaction. In such case, YOU must notify within 48 hours from your arrival day. PLUSHOLIDAYS has an emergency service available 24 hours a day and will try to solve the problem as quickly as possible.
It is important that the guest assumes and understands that the occurrence of incidents is inherent to the use of the property and that sometimes the appearance of these incidents is impossible to foresee (example: problems with septic tank, problems with boilers, faucet breaks, electric failures, etc.), and in other situations, they may be outside our control (example: general light cuts, neighbourhood works, neighbour or animal noises, insects existence, etc.)
PLUSHOLIDAYS team is available throughout the duration of your stay to resolve all issues and help you to enjoy a happy stay.
11- EXONERATION OF RESPONSIBILITIES
PLUSHOLIDAYS will not assume any responsibility about the possible modifications that affect the accommodation or its surroundings thereof not controllable directly by PLUSHOLIDAYS. The occupant assumes that he can not claim any penalty for the fact that any of the following anomalies exist as long as they have not been prevented or foreseen by PLUSHOLIDAYS:
- Works: The accommodations are usually privately owned by different individual owners and are generally located in large residential areas. Accommodations are not usually found in resorts, so although it is unlikely, potentially unexpected works may occur in the surroundings. These works are usually carried out by owners, contractors or governmental organizations with whom we have no relation and for that reason we have no influence in these actions. Therefore, the guest assumes when hiring their villa that neither PLUSHOLIDAYS nor the owner of the villa have any responsibility regarding the inconveniences caused by the works that are not carried out by order of the Provider of the accommodation.
- Satellite / Cable TV: If the description says satellite or cable TV, this does not mean that you can receive all the programs you want. The owners of the houses, mostly foreign, have decoders that do not always get all the international channels.
- Water, electricity and Internet; Cuts in water, electricity or Internet supplies are not usual in the Valencian Community. However, municipal and / or regional authorities may, for different reasons, agree to temporarily cut or limit the distribution of these supplies. In no case may PLUSHOLIDAYS be held responsible for the caused inconveniences or damages.
12- DATA PROTECTION
The personal data provided by the tenant in the contact form and / or booking form will be incorporated into a file whose ownership belongs to PLUSHOLIDAYS. The purpose of the collection and treatment thereof is the administrative management of the requested service, the maintenance of established commercial relations, as well as to keep the guest informed of new services and offers. In compliance with current regulations, PLUSHOLIDAYS guarantees that it has adopted the necessary measures and techniques to maintain the level of security required in accordance with the nature of the processed data. We also inform you that you can exercise your rights of access, rectification, cancellation and opposition, regarding your personal data, sending a letter, accompanied by your ID, to the address indicated in the reservation voucher. PLUSHOLIDAYS will not cede or communicate the data stored in their files to third parties, except in those cases in which such communication is authorized by the user, required by current legislation or is necessary for the provision of the requested service.
13- APPLICABLE LEGISLATION AND JURISDICTION
In all that is not foreseen in the present conditions, will be applicable, in all cases, the Spanish legislation, as well as the autonomic regulation. The parties, expressly waiving the jurisdiction that by law may correspond to them, are subject to the jurisdiction and competency of the courts and tribunals of the city of Denia for the resolution of any management derived from the application and interpretation of this contract.
